1. Agreement to these Terms
These Terms of Service are an agreement between you and PepStack, the operator of PepTrace, regarding your access to and use of the PepTrace mobile application, website, waitlist, subscriptions, and related services. By creating an account, downloading the app, joining the waitlist, starting a trial, purchasing a subscription, or using PepTrace, you agree to these Terms.
If you do not agree to these Terms, do not use PepTrace. If you use PepTrace on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.
2. Wellness tool, not medical advice
PepTrace is a tracking, organization, and wellness-support tool. It is not a medical device, medical service, pharmacy, healthcare provider, clinical decision tool, diagnosis tool, treatment plan, prescription service, or substitute for professional medical advice.
PepTrace does not recommend that you start, stop, change, dose, combine, obtain, or administer any medication, peptide, supplement, therapy, injection, workout, nutrition plan, or health intervention. Any information you enter, view, organize, or receive through PepTrace is for personal tracking and general informational purposes only.
Always consult a qualified healthcare professional before making decisions about medications, peptides, supplements, injections, symptoms, side effects, protocols, diet, exercise, recovery, laboratory results, or any health condition. If you think you may have a medical emergency, call emergency services immediately.
3. Your responsibility for protocols and health decisions
You are responsible for the accuracy of information you enter into PepTrace, including substances, doses, units, schedules, reconstitution details, inventory, reminders, workout data, nutrition, hydration, sleep, weight, symptoms, and notes.
PepTrace may display calculations, reminders, trends, adherence information, estimated inventory, or other outputs based on your entries. These outputs may be incomplete, delayed, inaccurate, or unsuitable for your circumstances. You must independently verify all information before relying on it.
You agree to use PepTrace only in compliance with applicable laws, prescriptions, medical instructions, product labeling, and safety requirements. PepTrace is not responsible for your possession, acquisition, use, dosing, administration, or storage of any medication, peptide, supplement, or other substance.
4. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to use PepTrace. By using PepTrace, you represent that you meet this requirement and that your use of PepTrace is lawful where you are located.
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you believe your account has been accessed without permission.
5. Trials, subscriptions, billing, and refunds
PepTrace may offer free features, paid features, trials, auto-renewing subscriptions, or one-time purchases. Pricing, renewal periods, included features, and trial terms will be shown before purchase.
If you purchase through Apple App Store, Google Play, or another app marketplace, your purchase is also governed by that store's terms, billing rules, cancellation process, and refund policies. You can manage or cancel marketplace subscriptions through your app-store account settings.
Except where required by law or by the applicable app-store policy, payments are non-refundable and subscription fees are charged in advance. We may change prices or plan features in the future, but we will provide notice where required.
6. Privacy, health data, and integrations
PepTrace is designed for personal and sensitive wellness data. Our collection, use, storage, and sharing of personal information is described in our Privacy Policy. You should review the Privacy Policy before using PepTrace.
If you connect PepTrace to Apple Health, HealthKit, Google Fit, or another health-data integration, you control the permissions available through that platform. PepTrace will use connected data only to provide app functionality you enable, subject to the permissions and platform rules that apply.
You retain ownership of the personal content and data you provide. You grant PepTrace a limited license to host, process, display, transmit, back up, and analyze that data as necessary to operate, secure, support, and improve the service.
7. Limited app license
Subject to these Terms, PepTrace grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the app for your own lawful personal wellness tracking. The app is licensed, not sold.
If you download PepTrace from the Apple App Store and we do not provide a separate custom end-user license in App Store Connect, Apple's standard licensed application end-user license agreement may also apply. If there is a conflict between marketplace terms and these Terms, the marketplace terms apply only to the extent required by that marketplace.
8. Acceptable use
You agree not to:
- use PepTrace for unlawful, unsafe, fraudulent, or abusive purposes;
- use PepTrace to diagnose, treat, prevent, or cure any disease or condition;
- enter or share information you do not have the right to use;
- reverse engineer, copy, scrape, resell, or exploit PepTrace except as allowed by law;
- interfere with PepTrace security, infrastructure, accounts, billing, or access controls;
- upload malware, harmful code, or content that violates another person's rights.
9. Notifications and reminders
PepTrace may allow you to create reminders for doses, workouts, hydration, rest, recovery, schedule events, or other personal activities. Reminders can fail, arrive late, or be affected by device settings, network conditions, operating-system behavior, battery mode, notification permissions, or app-store platform limits.
You should not rely on PepTrace reminders as your only method for remembering medication, treatment, emergency care, or any time-sensitive health activity.
10. Intellectual property
PepTrace, including its design, software, interface, brand, graphics, icons, copy, workflows, and other materials, is owned by PepTrace or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of PepTrace to you.
11. Disclaimers
PepTrace is provided "as is" and "as available." To the maximum extent permitted by law, PepTrace disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted or error-free operation.
We do not guarantee that PepTrace will be accurate, complete, secure, available, suitable for your health needs, compatible with every device, or free from data loss or service interruptions.
12. Limitation of liability
To the maximum extent permitted by law, PepTrace and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, health-related decisions, personal injury, treatment outcomes, business interruption, or loss of goodwill arising from or related to PepTrace or these Terms.
To the maximum extent permitted by law, PepTrace's total liability for any claim related to PepTrace or these Terms will not exceed the greater of the amount you paid to PepTrace for the service in the 12 months before the claim or USD $100.
13. Indemnity
You agree to defend, indemnify, and hold harmless PepTrace and its owners, employees, contractors, affiliates, service providers, and licensors from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of PepTrace, your data, your health decisions, your violation of these Terms, or your violation of law or another person's rights.
14. Suspension and termination
We may suspend or terminate access to PepTrace if we believe you violated these Terms, created risk for PepTrace or other users, used the service unlawfully, failed to pay required fees, or if we discontinue the service. You may stop using PepTrace at any time.
15. Changes to PepTrace or these Terms
We may update PepTrace and these Terms from time to time. If a change is material, we will provide notice through the app, website, email, or another reasonable method. Your continued use of PepTrace after the effective date of updated Terms means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, except where mandatory consumer protection laws require another law to apply. You may also have rights under the laws of the place where you live that cannot be limited by these Terms.
If a dispute arises, contact us first so we can try to resolve it informally. Nothing in these Terms limits rights you may have under laws that cannot be waived by contract.
